From whom we collect information

Witz collects certain information from our website visitors. This includes, but is not limited to, personal identifiers, including any of the following: your name, postal address, IP address, email address, social security number, driver’s license number, other government-issued identification number, signature, bank account number, credit card number, debit card number, payment method and other financial information, records of products or services you’ve purchased from us or our partners, internet or other electronic network activity information, including, browsing history, search history, and information regarding your interaction with our websites.

How personal information is collected

We collect your internet or other electronic network activity information when you access our websites. We do this through the use of cookies and other Computer Tracking Technologies. Additionally, we may collect any of your personal identifiers through the use of online forms which you may choose to submit.

We collect most of this personal information directly from you—in person, by telephone, text or email and/or via our website. However, we may also collect information:

  • From publicly accessible sources (e.g., property records);
  • Directly from a third party (e.g., sanctions screening providers, credit reporting agencies, or customer due diligence providers);

How Personal Information is used:

Personal information collected by Witz will be used by Witz for the following purposes:

  • Business Uses: to provide you with an enhanced and tailor-made experience when visiting our websites and to provide you with appropriate marketing materials, upon your request,  to set up a payment processing account for your organization; we are required by the payment processing institutions we work with to collect this information, to transmit the details of your transaction to the appropriate Card Association or network (such as Visa, Mastercard, Discover and American Express) so that they may verify and approve your transaction, to maintain a record of your transactions with us so that we may provide you with more efficient and effective service.
  • Marketing Uses. The information you provide to our websites may also be collected, used, analyzed and/or processed by Witz, or selected third parties on Witz’s behalf, for marketing and other business purposes.
  • Stored Information Uses. Witz stores and retains the information entered on our websites. Stored information is used by Witz and its partners: to support customer interaction with our websites, to deliver customer purchases, and/or to contact visitor again about other Witz services and products.
  • Online Advertising. Some companies that help Witz deliver interactive online advertising, such as banner ads, may collect and use information about Witz’s visitors to help Witz better understand the types of advertising or promotions that are most appealing to Witz’s customers.
  • Mergers and Acquisitions. For the purpose of developing and expanding its business, Witz may share, rent, sell or buy business assets. In such transactions, visitor information is generally one of the transferred business assets. Also, in the event Witz is acquired, visitor information will be one of the transferred assets.
  • Agents. Witz employs or engages other companies and individuals to perform business functions on behalf of Witz. These persons are provided with personal identifying information required to perform their functions, but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions, which include but are not limited to, fulfilling orders, delivering packages, removing repetitive information from visitor lists, analyzing data, providing marketing assistance, processing credit card payments and providing customer services.
  • Affiliated Businesses. Witz works closely with affiliated businesses operating website stores, providing services or selling products on each other’s websites. These businesses identify themselves to customers. Visitor information related to a transaction with an affiliated business is shared with that affiliated business.
  • Disclosure to Governmental Authorities. Witz releases personal identifying information when Witz reasonably believes release is appropriate to comply with law, to enforce Witz agreements, or to protect the rights, property or safety of Witz customers. Witz may also release such information in an exchange of information with other companies and/or organizations for the purposes of fraud protection and credit risk reduction.

Information from Children:

Our Website is intended for those 18 years of age and older and thus is not structured to attract anyone under 13. We do not knowingly collect personal information from children under 13.

Use of Computer Tracking Technologies.

  • Use of Cookies. Witz and its partners, collect non-identifiable and personal information through the use of various technologies, including “cookies.” A cookie is an alphanumeric identifier that a website can transfer to visitor’s hard drive through visitors’ browser. The cookie is then stored on visitor’s computer as an anonymous tag that identifies the visitor’s computer. Cookies may be sent by Witz or its partner. Visitors to our websites may set their browser to notify them before a cookie is received, giving an opportunity to decide whether to accept the cookie. Visitors may also set their browser to turn off cookies; however, some websites may then not work properly.
  • Use of Web Beacon Technologies. Witz and its partners may also use Web beacons or other technologies to better tailor our websites to provide better customer service. If these technologies are in use, when a visitor accesses these pages of our websites, a non-identifiable notice of that visit is generated, which may be processed by Witz or its partners. Web beacons usually work in conjunction with cookies. If a visitor does not want cookie information to be associated with visitor’s visits to these pages, visitors may set their browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages.
  • Collection of Non-Identifiable Information. Witz or its partners may collect non-identifiable information from user visits to our websites in order to provide better customer service. Examples of such collecting include traffic analysis, such as tracking of the domains from which users visit or tracking numbers of visitors; measuring visitor activity on our websites; website and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” Witz or its partners may use this data to analyze trends and statistics.
  • Commitment to Online Security. Witz intends to protect visitor’s personal information and to maintain its quality. To achieve information security and quality, Witz implements appropriate measures and processes, such as using encryption when transmitting certain sensitive information.

No Liability for Acts of Third Parties.

Witz will exercise reasonable efforts to safeguard the confidentiality of visitor personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, Witz shall not be liable for unauthorized disclosure of personal information due to no fault of Witz including, but not limited to, errors in transmission and unauthorized acts of Witz staff and third parties. Our websites may contain links to other websites. Witz is not responsible for the privacy practices or the content of those other websites.

Privacy Policy Changes and Opt-Out Rights.

  • Changes to Privacy Policy. This privacy notice was last updated on August 11, 2021. Witz reserves the right to change its privacy policy statement at any time and your continued use after we make changes is deemed an acceptance of those changes.
  • Opt-Out Right. Visitor may have the right to cease permitting personal information to be collected, used, or disclosed by Witz and/or by any third parties with whom Witz has shared and/or transferred such personal information. Rights of cancellation may be exercised by contacting Witz via e-mail, telephone or postal mail.

Access Rights to Data.

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your personal information from our records; and
  • Direct any service providers to delete your personal information from their records.

Please note that we may not delete your personal information if it is necessary to:

  • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
  • Debug to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
  • Comply with an existing legal obligation; or
  • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.
Protection Against Discrimination

You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things:

  • Deny goods or services to you;
  • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
  • Provide a different level or quality of goods or services to you; or
  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Please note that we may charge a different price or rate or provide a different level or quality of goods and/or services to you, if that difference is reasonably related to the value provided to our business by your personal information.
